TERMS OF SERVICE

By accessing or using the Mr. EveryKnows mobile application or the MrEveryKnows.com website (collectively, the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

Mr. EveryKnows is a movie knowledge, trivia, and strategy game platform developed and operated by Joupe, Inc. The Service includes the Mr. EveryKnows mobile application, the MrEveryKnows.com website, and any related features, content, and services provided by Joupe, Inc.

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 13, you may not use the Service.

Mr. EveryKnows does not currently require account registration. Your player profile information is stored locally on your device.

If you use Casting Director multiplayer features, certain gameplay information (including your player-selected screen name and an anonymous device identifier) may be associated with your session on Joupe, Inc. servers. See our Privacy Policy for full details.

The Service is provided for personal, non-commercial use only. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• ·Cheat, exploit bugs, or use unauthorized software, scripts, or methods to gain an unfair advantage in gameplay
• ·Reverse engineer, decompile, disassemble, or attempt to derive source code from any part of the Service
• ·Impersonate another player, person, or entity
• ·Engage in abusive, harassing, or disruptive conduct in multiplayer features
• ·Scrape, crawl, or systematically collect data from the Service without prior written authorization from Joupe, Inc.
• ·Use the Service for any commercial purpose without written authorization from Joupe, Inc.
• ·Use the Service in any manner that violates applicable local, state, national, or international law

The following elements of the Service are owned by Joupe, Inc. or its licensors and are protected by applicable intellectual property laws:

• ·Software and source code
• ·Branding and trademarks, including "Mr. EveryKnows" and related marks
• ·Artwork and graphics
• ·Original text and copy
• ·Visual design
• ·Proprietary game content
• ·Original presentation and implementation of the games
• ·Other intellectual property owned or licensed by Joupe, Inc.

Movie and cast data used within the app is sourced from The Movie Database (TMDB) and is subject to TMDB’s terms of use. Mr. EveryKnows is not endorsed or certified by TMDB.

You may not reproduce, distribute, publicly display, or create derivative works from any part of the Service without prior written permission from Joupe, Inc.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Joupe, Inc. does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. Your use of the Service is at your own risk.

To the maximum extent permitted by applicable law, Joupe, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if Joupe, Inc. has been advised of the possibility of such damages. In no event shall Joupe, Inc.’s total liability to you exceed the amount you paid, if any, for access to the Service in the twelve months preceding the claim.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

Joupe, Inc. reserves the right to modify these Terms at any time. The effective date at the top of this page will be updated to reflect the date of the most recent revision. Your continued use of the Service after any revision constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
